Trump Fires Back After Mamdani Explores Arresting Netanyahu in New York

Donald Trump declared that Benjamin Netanyahu will not be arrested during any visit to the United States, directly rejecting recent efforts by New York City Mayor Zohran Mamdani to explore whether the city could act on an International Criminal Court arrest warrant. Trump’s comments came as debate intensified over the legal authority of local officials to detain a foreign leader on American soil.

The president made his position clear in a Truth Social post, writing: «Benjamin Netanyahu will not be arrested, in any way, shape, or form, while in the United States of America. He is fighting against the Islamic Republic of Iran, which recently killed 52,000 innocent protestors, and has spent the last 47 years killing American Soldiers, and others.» The message left no doubt about the administration’s position.

Trump continued by shifting his criticism toward Iran instead of Netanyahu. He wrote: «The only ones that should be arrested are the people that led Iran into this unprecedented SPIRAL OF DEATH AND DESTRUCTION, something that should have been dealt with years ago, by previous Presidents!» The comments reinforced his longstanding support for Israel while dismissing the legitimacy of legal efforts targeting its prime minister.

Trump’s statement followed remarks by New York City Mayor Zohran Mamdani, who recently confirmed that his administration is reviewing whether the city has any authority to act on the International Criminal Court warrant. Speaking on The New York Times podcast, Mamdani said Netanyahu belongs before the court in The Hague and confirmed that the city’s Law Department is examining the legal options available.

Although he acknowledged that the legal review is still underway, Mamdani said his administration would pursue any authority available under the law. He stated: «Whatever the law allows me to do in New York City, that’s what we will do.» The mayor has also described Netanyahu as a «war criminal» and the «architect of the genocide» against Palestinians in Gaza, citing the ICC warrant issued in 2024.

The International Criminal Court issued arrest warrants for Benjamin Netanyahu in November 2024 over alleged war crimes and crimes against humanity connected to the war in Gaza. The court’s decisions are binding only on member states that recognize its jurisdiction, creating different legal obligations depending on the country involved.

Legal experts have widely concluded that an arrest in New York would be extremely unlikely. The United States is not a party to the Rome Statute that created the ICC, meaning the federal government does not recognize the court’s jurisdiction. As a result, ICC arrest warrants are not automatically enforceable under U.S. law.

Another major obstacle is diplomatic immunity. Visiting heads of government are generally protected under both U.S. and international law while traveling on official business. Those protections make it exceptionally difficult for local authorities to take enforcement action against foreign leaders regardless of ongoing international legal proceedings.

Experts have also emphasized that issues involving foreign dignitaries fall under federal jurisdiction rather than the authority of cities or states. Former government officials and New York Governor Kathy Hochul have noted that decisions involving international leaders would be handled by federal agencies such as the State Department and the Secret Service, not by the New York Police Department.

If Netanyahu were visiting New York to attend meetings at United Nations headquarters, additional legal protections would apply. The U.N. Headquarters Agreement guarantees access for foreign representatives attending official U.N. functions, further limiting the ability of local authorities to interfere with those diplomatic visits.

The public exchange between Trump and Mamdani highlights the growing divide within the United States over Israel, Gaza and the role of international justice. While Trump argues Netanyahu should face no legal consequences in America, Mamdani insists international law should be respected. Even though legal experts believe an arrest is virtually impossible, the dispute has intensified political debate over the ICC, diplomatic immunity and America’s relationship with one of its closest allies.
