Spencer Elden has taken the band Nirvana to court, claiming that the image of him as a baby where he was naked on the album Nevermind released in 1991, constituted an abuse.

Elden finally lost in this lawsuit he filed (January 2022).

At the time, the family was paid $200 for the band to use said photo.

Elden claims that the image caused him permanent harm, reports The Guardian.

When he was a child, he was unable to give his consent for this photo to be used.

He's back at it again, asking for about $200,000 in damages.

In the end, U.S. District Judge Fernando Olguin dismissed the case...

...due to the delay of the complaint, which was more than ten years old. Nirvana also pleaded that Elden had taken ample advantage of his status for personal and professional gain.
